These Terms of Service ("Terms") govern access to and use of 4ACE websites, products, and services ("4ACE", "Service"). By using 4ACE, you agree to these Terms.
This is draft v1 legal copy and should be reviewed before production reliance. Items such as governing law, venue, liability cap, refunds, and indemnity need final legal review.
Who May Use 4ACE
4ACE is built primarily for motorsport, racing, engineering, and team use. You may use 4ACE only if you can form a binding agreement, have required authority, and comply with these Terms.
If you use 4ACE for an organization or team, you represent that you have authority to bind that organization or team.
Accounts and Teams
You are responsible for your account, credentials, team membership, and activity under your account. Keep credentials secure and notify us if you believe your account has been compromised.
Team owners and administrators may control access, roles, permissions, billing, customer content, and related workspace settings. Users added to a team may be subject to team administrator decisions.
Credits and Payments
4ACE may offer pay-as-you-go credits, top-ups, or similar prepaid usage. Unless stated otherwise at checkout:
- credits are purchased through Stripe or another payment provider
- taxes may apply
- credits do not create a subscription by themselves
- credits may be consumed by eligible product usage
- unused credits, refunds, expiration, and transferability need final policy confirmation
Payment providers may apply their own terms and privacy notices.
Customer Content
You keep ownership of content, data, files, setup information, racing information, team information, notes, and other materials you submit to 4ACE ("Customer Content").
You grant 4ACE a limited license to host, process, transmit, display, analyze, and otherwise use Customer Content as needed to provide, secure, support, and improve the Service, comply with law, and enforce these Terms.
You are responsible for Customer Content, including whether you have required rights and permissions to upload, share, or process it.
Acceptable Use
You must not use 4ACE to:
- break applicable law or regulations
- infringe privacy, intellectual property, or contractual rights
- upload malicious code or attack systems
- bypass access controls, rate limits, billing, or security controls
- interfere with service reliability or other users
- scrape, reverse engineer, or misuse the Service except where law allows
- submit content that is unlawful, harmful, abusive, or misleading
We may suspend or restrict access if we believe use creates legal, security, abuse, payment, or operational risk.
Third-Party Services
4ACE may rely on third-party services for authentication, payments, hosting, analytics, logging, monitoring, email, support, and related operations. Third-party services may be governed by their own terms and privacy notices.
We are not responsible for third-party services outside our control.
Availability and Changes
We aim to provide reliable service, but do not guarantee uninterrupted or error-free availability. We may modify, suspend, or discontinue parts of 4ACE as the product evolves.
We may update features, limits, pricing, credit rules, or technical requirements. If changes materially affect you, we will use reasonable notice where practical.
Confidentiality
If you share non-public team, racing, setup, business, or technical information through 4ACE, we will handle it in line with these Terms and our Privacy Policy. Do not submit highly sensitive information unless 4ACE is configured and intended for that use.
Intellectual Property
4ACE and its software, design, documentation, trademarks, and other materials are owned by 4ACE or its licensors. Except for rights expressly granted in these Terms, no rights are transferred to you.
Feedback may be used by 4ACE without restriction or obligation, unless separately agreed in writing.
Disclaimers
4ACE is provided on an "as is" and "as available" basis to the maximum extent permitted by law. Motorsport decisions can involve safety, financial, and competitive risk. You are responsible for validating outputs, recommendations, setup decisions, and operational choices before relying on them.
Limitation of Liability
Liability limits need final legal review. To the maximum extent permitted by law, 4ACE will not be liable for indirect, incidental, special, consequential, punitive, or exemplary damages, or for lost profits, lost revenue, lost data, loss of goodwill, or business interruption.
Termination
You may stop using 4ACE at any time. We may suspend or terminate access if you breach these Terms, fail to pay amounts due, create risk, or if continued service is not practical or lawful.
Certain sections survive termination, including payment obligations, ownership, confidentiality, disclaimers, liability limits, and provisions needed to interpret or enforce these Terms.
Governing Law
Governing law, venue, dispute process, and consumer-law carveouts need final legal review before production reliance.
Changes to These Terms
We may update these Terms as 4ACE changes. Updated Terms will be posted with a revised last updated date. Continued use after changes means you accept updated Terms, unless law requires another process.
